Welcome to the Simchonim website (henceforth: “the site”). The site is a virtual store and serves as an electronic mall for the purchase of products by online users in Israel. The owner and operator of the site is Simchonim, by Simchonim Shai Ltd (henceforth: “the site operator.”)

  1. General
  2. Wherever the male gender is used in this document of terms and conditions, the intention also includes the female gender.
  3. Anyone who conducts any action on the site (henceforth: “the user”) declares that he has read, understood and agrees to the terms and conditions of the site, and that he and/or anyone on his behalf will have no complaints and/or claims against the owners of the site and/or its operators and/or anyone on their behalf, aside for claims relating to a violation of the obligation of the owners of the site and/or its operators according to this set of terms and conditions and the participation rules. Surfing on the site and/or purchasing products or services being offered for sale on the site, serves as an agreement by the user to accept these terms and conditions, and to act according to them.


  1. How Sales Are Carried Out on the Website
  2. Simchonim makes it possible for you to purchase its products via the website, in a comfortable, quick and easy fashion. Photos and a short description of each product can be viewed on the site. For more detailed information about the product, userscan call Simchonim’s customer service center, or send a query via email. The photos on the website are for illustrative purposes only, and there may be differences between the photographs on the site – some or all of them – to the products that are actually sold. If there is an error in the written description of a product or service, Simchonim will not be bound by it.
  3. All the amounts and prices presented on the various sales pages include VAT, if the transaction is taxable for VAT by law, unless specifically stated otherwise.
  4. The completion of the sales process is contingent on a confirmation that the desired product is in stock with the company when the purchase process is completed. In the event that the product is not in stock, a message will be sent to the customer via internet. In such a case, the user will immediately be refunded for the amount he paid. The company is not responsible for any direct or indirect damage that will be caused to the one placing the order due to failure to receive the product because it is out of stock.


  1. Payment and Delivery
  2. Before the product order (henceforth: “the transaction”) is finalized the user will first have to key in basic details, such as name, address, email address, phone number, credit card number, ID number and other details, as required. At this point, the user becomes the executor of the action (henceforth: “the buyer”). In order for the order to be executed rapidly, without any problems, one should be careful to insert the correct details, otherwise we cannot guarantee that the order will be filled. Registering for the site serves as your agreement to open a client account, and to joining the site’s mailing list.
  3. As soon as the transaction is executed, the details of the credit card will be checked, and once the credit card company approves the transaction, the relevant message will be sent that the transaction was approved or rejected. In the event it is approved, the order will be registered in the site’s system. Likewise, a confirmation will be sent by email that the transaction will be carried out within 48 hours of when the order was confirmed. The buyer will be charged for the product or service that he has purchased with the credit card after the order is executed. The buyer will have the right to contact the site to change the charging details, including the number of payments. Simchonim will implement the changes in accordance with the policy of the credit companies as that time. In the event that the credit card company charges Simchonim a fee for carrying out the transaction, the buyer will be charged that fee. Please note: Providing incorrect details is a crime, and one who does so can be prosecuted under full authority of criminal and civil law.
  4. In the event that the transaction is not approved by the credit card, the buyer will receive a relevant message to that effect. In order to complete the purchase, the buyer will be asked to make telephone contact with the company’s customer service department to arrange an approval from the credit card company for the transaction. It must be stressed that a transaction is considered complete only after the credit card company approves the transaction by the buyer. In the aforementioned case, delivery time will be calculated from when the transaction is approved by the credit card company. If the buyer does not take steps to arrange the approval within seven days of receiving the message that the credit card company declined the payment, Simchonim has the right to cancel the order.
  5. In the event that the buyer decides not to provide credit card information on the website, wishes to do so by phone, a representative of Simchonim will make contact with him to receive the information. The transaction will be considered complete only after the credit card details are provided by the buyer, and the credit card company approves the transaction. In this case, the delivery time will be calculated from the time the credit card details and the approval of the credit card company are received. It should be emphasized that if the buyer chooses the option of having a Simchonim representative contact him by phone to receive credit card information, and the client does not answer the phone call and/or email from the company within seven days of contact, the order will automatically be cancelled.


  1. Delivery and Transport
  2. Simchonim will make sure to supply every product purchased by the buyer on the site to an address in Israel, which was keyed in during the order, within 14 business days, unless otherwise noted on the site. In areas with restricted access due to security reasons, Simchonim reserves the right to supply the products to the buyer in an accepted location, which will be coordinated ahead of time. The delivery date of the products/services as noted on the sales sheet takes into account only business days (Sun.-Thurs., not including Friday, Shabbos, Erev Chag and Chagim.) Orders that are received after 12:00 midday are considered to have been received the following business morning.
  3. The company is not responsible for any lateness or delay in the delivery and/or lack of delivery caused by a force majeure and/or events that are beyond the company’s control, including strikes, walkouts and the like. In any event, Simchonim’s liablity with regard to lateness, delays or delivery failures for items or services purchased on the site will be limited to direct damages, which may be caused due to an action or mishap by Simchonim or anyone working on its behalf. This liability will not exceed the cost of the product or service purchased by the user. Simchonim and/or anyone on its behalf will not be responsible for, and will not cover any indirect, special or consequential damage caused to the buyer because of a lateness, delay or failure to supply the product or service – whatever the claim may be – including loss of income and/or preclusion of profit that is caused for whatever reason.
  4. The delivery fees specified on the site do not include unusual delivery circumstances and/or international delivery rates. Unusual circumstances can include delivery to a high floor without an elevator, and/or delivery that requires additional manpower and/or special resources. In the event of an unusual delivery circumstance and/or delivery outside Israel, Simchonim reserves the right to charge an additional fee above the regular delivery fee.
  5. Simchonim’s deliveries are carried out through Israel Post (courier service). The Israel Post regulations will apply to every delivery/transport of any product through the website, and will be binding on any bidder. It should be noted that delivery via courier will be done to the door, except in communal settlements, villages, kibbutzim and suchlike, where the product will be delivered to the closest post office to the settlement, or to the secretary’s office of the settlement and suchlike. The client will then receive a notice home.
  6. The buyer may reserve the right to collect the product from the Simchonim offices. The buyer should note in the relevant space while making the purchase that he wishes to pick up of the product from the offices. In order to do this, the buyer should contact Simchonim’s customer service department to make up a time and place for the pickup. Pickup must take place within 14 business days from the time the order is confirmed.
  7. It should be noted and emphasized that for any relevant matter, the place where the transaction was executed is where the suppler is based, even in the event that the client who won a sale or purchased a product opts to receive the product by mail or via courier.
  8. In any case where there is a request to cancel the transaction for reasons other than a damaged product, or an incompatibility between the product or service and the details that were given to the client, and the product has already been shipped, then the buyer must return the product in its original packaging, fully intact and/or without any damage and/or harm and/or flaw of any kind or type, to Simchonim, on his own account, within 14 days. The results of the cancellation do not derogate from the right of Simchonim to sue for damages on grounds of devaluation of the product because of a deterioration in its condition.

It should be noted that orders with personalized inscriptions or otherwise personalized cannot be cancelled unless there is an error for which Simchonim is at fault.

  1. Use of the Website
  2. Every user has the right to make a purchase on the site, subject to the fulfillment of the following conditions:
  • The user is of the ability to carry out binding legal actions. In the event that you are a minor (under age 18) or do not have the right to carry out legal actions without the approval of a custodian, your use of the site will be assumed to have received the approval of the custodian.
  • The user has a valid Israeli ID card, or is a legally incorporated corporation registered in Israel.
  • The user owns a valid Israeli or international Visa or Isracard credit card, issued in Israel by one of the credit card companies.
  • The user has an email account on the internet in Israel and has an address in Israel.


  1. Without derogating from the above, Simchonim reserves the right to prevent the buyer from participating in sales on the website, by blocking him, in any one of the following incidences:
  • The buyer has committed an illegal act and/or has violated legal directives.
  • The buyer has violated one of the regulations of this site.
  • The buyer intentionally gave incorrect information during the registration for the site and/or afterwards by phone.
  • The buyer did something that could cause harm to Simchonim and/or anyone on its behalf and/or the proper function of the site and/or any third party.


  1. Information Security

Simchonim takes every accepted precaution in order to preserve, to the extent possible, privacy of information. Every transfer of a credit card number from the site is done in an encoded fashion, according to technology regulations, SSL. However, in cases sometimes out of its control and/or force majeure, Simchonim will not be liable for damage of any kind, direct or indirect, that is caused to the customer and/or anyone on their behalf, if this information is lost or if unauthorized use is made of it. Simchonim pledges not to convey customer information to a third party.


  1. Cancellation of a Purchase
  2. One who makes a purchase has the right to cancel the purchase in accordance with the Consumer Protection Law and its accompanying regulations. With regard to the purchase of certain items, the buyer will not be able to cancel the transaction, as detailed in Clause 14c (4) of the Consumer Protection law.
  3. Cancellation of the transaction will be done in writing, via fax and/or mail directly to Simchonim.
  4. Simchonim takes responsibility for its products. If the buyer cancels a transaction due to a fault in the product, or a discrepancy between the property or the service, and the items provided to it by Simchonim, then Simchonim will refund the buyer within 14 days of the receipt of the cancellation order. The refund will equal the price paid by the user. The user will no longer be bound by the transaction and no cancellation fees will be charged to the user. If the buyer received the product that the transaction or contract applies to he should arrange its return to Simchonim’s offices.
  5. In the event that the buyer seeks to personalize the product, it will be done only after the graphics are approved by the one making the order. The approval must be sent to the company via email or fax. No claims regarding graphics approvals by phone will be accepted.
  6. The provisions of this section will not apply to products and services provided for in Clause 14c(4) of the Consumer Protection Law.


  1. Cancellation of a Sale By Simchonim
  2. Simchonim reserves the right to cancel any transaction and/or sale, in its entirety or in part: In the event that there was a writing error in the order, whether regarding the price or description of the product. In the event of a force majeure event, war or terror attack that prevent the continuation of the sale and/or its execution, or if it becomes clear to the company that the transaction and/or sale involves illegal activity by the buyer and/or any third party.
  3. An announcement of the cancellation of the sale will be conveyed to the client by phone and/or in writing to the address that the client entered when registering for the sale.


  1. Additional Conditions
  2. The logo, brand, domain name, patents, copyrights, website designs, graphics, objects, product ideas, interface specifications, numbering methods, trade secrets, programs, site code, photos, including graphics, design, textual presentation, trade symbols, and logos, including their editing and presentation on the site, are exclusively owned by Simchonim and/or anyone representing them. No one may copy, duplicate, disseminate, advertise or use in any other way the content on the site, unless they are given written permission by Simchonim to do so.
  3. Simchonim reserves the right to send an email to a user, or to contact a user in writing or orally, with regard to sales information.
  4. Simchonim reserves the right to change prices without any advance notice. It is hereby clarified that the changes must not be made after the transaction has been confirmed.
  5. In the event that there are disputes between the sides regarding the interpretation and enforcement of these regulations and/or the enforcement and/or any other action or dispute that stem from it, they will be settled, if necessary, in the authorized courts in the Central District only, according to the laws of the State of Israel.
  6. Simchonim reserves the right to alter these regulations periodically, as per its discretion.
